Challenging an Unproved False-Document Allegation

An allegation about money-transfer slips threatened a family-permit application. We examined what the verification report actually proved and rebuilt the picture of genuine support.

01 / Overview

Executive summary

Mr. F.’s refusal relied on an allegation that earlier remittance slips were false. The verification material was brief and incomplete. We challenged its reliability alongside presenting substantial evidence of support and accommodation. The tribunal found the allegation unproved and allowed the appeal.

02 / Narrative

The factual background

The historical EEA family-permit case turned on dependency and an accusation concerning earlier MoneyGram records. The respondent relied on a late verification report.

The evidence before the tribunal did not include material showing precisely what the unnamed verifier had checked. Transfer documents said to be attached to the report were missing.

03 / Challenge

The issue at the heart of the case

The case required two connected arguments: whether the respondent had proved the accusation, and whether the client had established the underlying dependency. Answering only one would have left the other issue unresolved.

The focus of the case

The tribunal found that the respondent had not produced sufficiently cogent evidence to establish that the disputed slips were false.

04 / Approach

How the matter was approached

01

Examine the verification

We tested the report’s detail, provenance and supporting material.

02

Identify the missing evidence

We drew attention to the absence of the transfer documents and records said to support the allegation.

03

Prove genuine support

We relied on later financial support and accommodation evidence.

04

Explain the sponsor’s resources

Savings and overseas rental income helped explain how the sponsor could support the client despite modest UK earnings.

05 / Outcome

The result and its limits

Appeal allowed

Appeal allowed; the allegation was not proved.

The tribunal allowed the appeal in November 2022. The historical register records a visa copy from March 2023. An £80 appeal fee award was made, while a separate application for wasted costs exceeding £6,000 was refused.

The finding was that the allegation had not been proved. It was not a finding that the Home Office knowingly made a false accusation, and this was not a re-entry-ban appeal.

06 / Practical perspective

What this case illustrates

A

Test the accusation

A serious allegation needs evidence capable of supporting it.

B

Keep proving the application

Challenging an accusation should accompany a coherent case on eligibility.

C

State the remedy precisely

An appeal fee award is different from recovery of all legal costs.
